Medical Marijuana Program Regulations
There is no limit on the number of plants a registered organization can grow.
Public Health Law, Section 1, Article 33, Title 5-A
§ 3365(7)
Conduct in compliance with this title which may violate conflicting federal law, shall not be grounds to suspend or terminate a registration.
§ 3369(2)
This subdivision shall not require any person or entity to do any act that would put the person or entity in violation of federal law or cause it to lose a federal contract or funding.

N.Y. Agriculture & Markets §§ 505 to 514 (2017)
- Allows the growth of hemp as part of an agricultural pilot program by the Department of Agriculture and Markets and/or an institution of higher education.
- The commissioner of agriculture and markets may authorize no more than 10 sites for growing hemp as part of a pilot program.

The commissioner may develop regulations to authorize the acquisition and possession of industrial hemp seeds.
- 1 NYCRR 159.2 allows authorized growers to possess, grow and cultivate seeds and hemp plants.
